Article 1 - Definitions

In these terms and conditions is understood by:
- \n
- \nCooling-off period: the period within which the consumer can make use of their right of withdrawal; Read all about the cooling-off period\n \n
- \n
- \nConsumer: the natural person who does not act in the exercise of a profession or business and enters into a distance agreement with the entrepreneur; \n
- \n
- \nDay: calendar day; \n
- \n
- \nLong-term transaction: a distance agreement relating to a series of products and/or services, where the delivery and/or acceptance obligation is spread over time; \n
- \n
- \nDurable data carrier: any means that enables the consumer or entrepreneur to store information personally addressed to them, in a way that allows future consultation and unaltered reproduction of the stored information. \n
- \n
- \nRight of withdrawal: the possibility for the consumer to waive the distance agreement within the cooling-off period;\n \n
- \n
- Model form: the model form for withdrawal that the entrepreneur makes available and which a consumer can fill in when they wish to make use of their right of withdrawal. \n
- \n
- Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers; \n
- \n
- \nDistance agreement: an agreement where, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, exclusively one or more techniques for distance communication are used up to and including the conclusion of the agreement; \n
- \n
- \nTechnique for distance communication: means that can be used for concluding an agreement, without the consumer and entrepreneur having met simultaneously in the same space. \n
- \n
- \nGeneral Terms and Conditions: the present General Terms and Conditions of the entrepreneur. \n

Article 3 - Applicability
\n- \n
- These general terms and conditions apply to every offer from the entrepreneur and to every concluded distance agreement and orders between entrepreneur and consumer. \n
- \n
- Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance agreement is concluded that the general terms and conditions can be inspected at the entrepreneur's premises and that they will be sent free of charge to the consumer as soon as possible upon request. \n

- If the distance agreement is concluded electronically, in deviation from the previous paragraph and before the distance agreement is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not reasonably possible, it will be indicated before the distance agreement is concluded where the general terms and conditions can be consulted electronically and that they will be sent free of charge to the consumer electronically or in another way upon request. \n

- In the event that, in addition to these general terms and conditions, specific product or service conditions also apply, the second and third paragraphs apply accordingly, and the consumer can always invoke the applicable provision that is most favorable to them in case of conflicting general terms and conditions. \n

- If one or more provisions in these general terms and conditions are at any time wholly or partially void or are annulled, then the agreement and these terms and conditions will otherwise remain in force and the relevant provision will be immediately replaced in mutual consultation by a provision that approximates the scope of the original as much as possible. \n
- \n
- Situations not regulated in these general terms and conditions should be judged ‘in the spirit’ of these general terms and conditions. \n
- \n
- Unclarities about the interpretation or content of one or more provisions of our terms and conditions should be interpreted ‘in the spirit’ of these general terms and conditions. \n
Article 4 - The offer
\n- \n
- If an offer has a limited validity period or is made under conditions, this will be explicitly stated in the offer. \n
- \n
- The offer is without obligation. The entrepreneur is entitled to change and adapt the offer. \n
- \n
- The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable a good assessment of the offer by the consumer. If the entrepreneur uses images, these are a truthful representation of the offered products and/or services. Apparent mistakes or obvious errors in the offer do not bind the entrepreneur. \n
- \n
- All images, specifications data in the offer are indicative and cannot give rise to compensation or dissolution of the agreement. \n
- \n
- Images with products are a truthful representation of the offered products. The entrepreneur cannot guarantee that the displayed colors exactly match the real colors of the products. \n
- \n
- Every offer contains such information that it is clear to the consumer what the rights and obligations are that are attached to the acceptance of the offer. This concerns in particular:

- the price including taxes; \n
\n- \n
- the possible costs of shipping; \n
\n- \n
- the way in which the agreement will be concluded and which actions are necessary for this; \n
\n- \n
- whether or not the right of withdrawal applies; \n
\n- \n
- the method of payment, delivery and execution of the agreement; \n
\n- \n
- the period for acceptance of the offer, or the period within which the entrepreneur guarantees the price; \n
\n- \n
- the amount of the rate for distance communication if the costs of using the technique for distance communication are calculated on a different basis than the regular basic rate for the communication method used; \n
\n- \n
- whether the agreement is archived after its conclusion, and if so, how it can be consulted by the consumer; \n
\n- \n
- the way in which the consumer, before concluding the agreement, can check and, if desired, correct the data provided by them in the context of the agreement; \n
\n- \n
- any other languages in which, in addition to Dutch, the agreement can be concluded; \n
\n- \n
- the codes of conduct to which the entrepreneur has subjected themselves and the way in which the consumer can consult these codes of conduct electronically; and \n
\n- \n
- the minimum duration of the distance agreement in the case of a long-term transaction. \n
\n \n
Article 5 - The agreement
\n- \n
- The agreement comes into being, subject to the provisions in paragraph 4, at the moment of acceptance by the consumer of the offer and the fulfillment of the conditions set therein. \n
- \n
- If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically. As long as the agreement of this acceptance has not been confirmed by the entrepreneur, the consumer can dissolve the agreement. \n
- \n
- If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures for this. \n
- \n
- The entrepreneur can - within legal frameworks - inform themselves whether the consumer can meet their payment obligations, as well as all those facts and factors that are important for a responsible entering into of the distance agreement. If, based on this investigation, the entrepreneur has good reasons not to enter into the agreement, they are entitled to refuse an order or application with reasons or to attach special conditions to its execution. \n

- The entrepreneur will send the following information with the product or service to the consumer, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable data carrier:
